Abstract

A series of reflections and approaches are presented in this chapter, with which it is intended to introduce the reader to an oceanic theme, that is, the respect and guarantee with a differential approach, of the rights and duties of people in Colombia with special protection. constitutional, within the framework of the construction of peace that Colombian society longs for; committed for which, as a conceptualization, contextualization and characterization, a first section is an approximation to the supra-legal foundations of equality in the Constitutional, Social and Democratic State of Colombian Law; secondly, the respect and guarantee from the point of view of the differential approach is analyzed, taking into account the typology that normative, jurisprudential and doctrinally has been proposed in relation to these collectives; to culminate in a third part, with some recommendations for inclusion from the recognition of the difference, as a budget for guaranteeing and respecting the rights of the subjects of special constitutional protection, in the implementation of the following agreements derived from the process of peace.
