Implicaciones de utilizar títulos valores en materia de arrendamiento de vivienda urbana

While it is common the use of securities to support the obligations acquired by the lessee under an urban house lease contract, the truth is that it is more than unnecessary, inconvenient and injurious of the legal system. The regulation of urban housing lease prohibits the use of cash deposits or any real security to ensure the compliance to the obligations of the lessee, even through an intermediary or different document from the lease contract, including securities. Therefore, its utilization entails primarily an absolute nullity, not to mention inefficiency due to inexistence and a number of instructions that may turn into abuse. Despite being well-known, urban housing lease legislation situations are overlooked by judicial officials and lawyers involved, which is not consistent with law or justice.
