Towards an epistemological foundation of authorship in the offenses of duty infringement

This article, presented as an advance within the research framework of a doctoral thesis, aims to establish what are the epistemological foundations of the second Roxin category that delimits authorship and criminal participation within a social and democratic context of law, the Crimes in which the author is not the one who dominates the causal event, but the one who is guarantor of a duty (an institution in the jakobsian contribution) so naturalistically does not perform the behavior described in the type.This study will try to establish, for the theory of crime in general and for the dogmatics of authorship in particular, the propaedeutic and methodological foundations that relate three (3) systems of epistemological knowledge.
