Abstract

The Civilization eory tries an analytical reconstruction of history to balance the structural and subjective dimensions of society. It approaches to Law in its theory and practice as a part of the developing society. So, this eory is taken as an extension of the Critical eory inspired on Freud and Marx, and means a human auto-rethe Critical eory inspired on Freud and Marx, and means a human auto-reflection and auto-constitution movement. Since this perspective, the geo-political dimension comprehends more adequately the elements of international politics that takes part of the fight and diffusion of Law all around the world. The reconstruction of West historyand tradition in terms of pre-modern, modern and post-modern ‘mentalities’ followsthe continuities and dis-continuities of that tradition present in actual generation’sidentity and possibilities. Finally, following the history of Law as a part of the Western tradition in the long-term process, we can access more successfully to its trajectory and structural and subjective dimensions so artificially separated.
