Tis document is the result of an ongoing investigation that takes place at the Faculty of Law at St. Tomas University in Bogota, and what the group aims to study is the behavior of the “agents” due to the innovation of legislation who gets involved the Colombian penal system. Te theory Bourdieu fields is the starting point of the investigation to determine the aspects of legal sociology that affect the habitus of the agents involved in litigation. Terefore research on adversarial criminal justice system and legal habitus determine the variables that are more difficult to assimilate to the parties and those who appropriate easily. Te result of the research will be an academic support in discussions on the issue in favor of contributing the system to establish unfulfilled objectives and breeding strategies for most effective litigation and a process that guarantees fundamental rights fully.
