Form of conflict resolution within the Wayúu indigenous community

The resolution of conflicts through the years, has been based on a number of specific mechanisms that establish solutions to disputes and confrontations between the actors involved, derived from the culture of the people, their interests, pacts and agreements made. However, the resolution of conflicts in the Wayuu indigenous community has its precise variants focused on a practice typical of their territory, in accordance with its own rules and procedures, but whose effectiveness and legality depends on its status as adherence to rules imposed in that state territoriality, which is not always taken into consideration at the time of the occurrence of a hostile situation. Under such considerations, this study is based, with the aim of analyzing the resolution of conflicts within the Wayuu indigenous community. For these purposes, a comparative study which deals with the customary praxis and Western culture occurs. In this regard, a documentary research, focused on the paradigm of qualitative research, typical of the social sciences, and methods of science concerning hermeneutics are applied, in order to make the interpretation of doctrines and compiled theories is performed, interpretation of the law governing the matter and analysis raised some interviews. The findings, reveal weaknesses in the fair implementation of national laws, forcing the researcher to make suggestions and recommendations that attempt to bring different ideas to streamline conflicts arising between the parties to them.
