Violation Of Fundamental Human Rights Of People Resident In The Border Area Axis Department Of La Guajira - Zulia State

State political constitutions and documents derived from subscribing to international regulations express that states have a duty to protect the rights of citizens living on borders. This must happen in the axis formed by the Department of La Guajira and the State of Zulia. However, the efforts made so far, based on constitutional, legal and regulatory provisions, and public policies that could make such rights operational, do not cover the existing needs and expectations, so that citizens remain a vulnerable population. Hence, the purpose of this article is to analyze the situation of violation of the human rights of people on the Venezuelan and Colombian border, making the situation doubly sensitive, as it is an area that houses ethnic minorities. The study is carried out under a methodology based on the qualitative paradigm, with a post-positivist approach, carrying out an investigation typified as a bibliographic documentary, with data and information analyzed from a socio-critical interpretation and based on the researcher's experience and knowledge. It is clearly concluded that State policy in both countries does not adequately address this sociocultural conditioning factor, generating spaces for the transgression of individual, social and collective rights.
