Digital freedom of expression and the amparo trial: new challenges for the protection of fundamental rights in the age of social networks

Introduction: This article provides an in-depth analysis of one of the challenges facing freedom of expression in today's digital age, in which technological infrastructures have reshaped the nature of public debate. The study delves into current threats to individual rights online, with a particular focus on arbitrary content moderation, hate speech, and cyberbullying. It also highlights the importance of amparo proceedings as an essential legal mechanism for protecting users from abuses that arise in the context of digital platforms.
Objective: to analyze the application and effectiveness of amparo proceedings as a defense mechanism that safeguards human rights in the digital space.
Method: The research is documentary, comparative, and based on normative analysis, jurisprudential criteria, and theoretical review.
Results: A trend of recurring violations in the digital sphere and fundamental rights is detected, whereby amparo is consolidated as a preferred tool for citizens as a mechanism of protection against abuses in the virtual environment.
Conclusion: The amparo trial is an indispensable tool for protecting digital freedom of expression and generating jurisprudential criteria that strengthen the culture of peace.
