Abstract

The purpose or objective of this study is to conduct an analysis to determine the benefits of the implementation of orality within the Colombian and Venezuelan labor processes. Because although in Colombia anticipated orality from the issuance of the first laws regularin the matter there in the fifties of the last century, only it came to actually start your application from 1149 to 2007. This allows initial way to raise obtaining better results in terms of the length of proceedings, especially when you consider they were reduced from four to two hearings to define them, having the additional possibility of giving them terminated early if use of conciliation is made. For his part in the Bolivarian Republic of Venezuela, orality in labor processes constituted a reality from the issuance of the 1999 Constitution, implementation that prima facie seem to have fared better than ours, which is mainly attributable to the way the first instance in the work processes handled the neighboring country, which is developed through two hearings, a preliminary call and another known as trial hearing, conducted by two different judges: support, mediation and implementation, and another called trial. The protagonist in this process is the mediator judge, charged with developing a great activity aimed at seeking early termination of the process using one of the conciliation or arbitration achieving success.
