Facebook and WhatsApp as Digital Evidence in Mexico’s Adversarial Criminal Justice System

The jurisprudential criteria that the Supreme Court of Justice of the Nation in Mexico has issued in relation to social networks and the data, means of evidence and evidence obtained from different digital platforms, such as Facebook, WhatsApp, Instagram among others, were analyzed, it was determined whether they fit the parameters regarding authenticity, obtaining, and offering that the legislation has established in the accusatory criminal process in Mexico. The objective was to identify the most common problems in the incorporation of digital evidence in the accusatory criminal process in Mexico. The method used was analysis, the documentary technique and the semi-structured interview technique applied to judges and trial lawyers who work in the adversarial criminal process.
