Some reflections on the need to reform the law of pardon in Spain

This paper addresses a legal and also political reflection on the social and political debate generated in Spain as a result of the independence process initiated by the Catalan authorities in 2017, with the approval of laws for the disconnection from the Spanish State and the holding of an illegal referendum in Catalonia. Those responsible were convicted and subsequently pardoned by the Government. It is considered that the instrument of pardon is the greatest interference of the political power over the judiciary and it is proposed to face a reform of the Law regulating this institution of grace that dates from 1870 but that never before, had generated the legal debate on the urgency of a reform that emphasizes greater requirements for its concession as the abuse of the institution damages a basic pillar of democracy which is the basic judicial independence in a State under the rule of law.
