The Interview with Audiovisual Media and its Assessment in Colombian Criminal Procedure

The reference test as a material probative element and / or physical evidence of which its legal and jurisprudential impairment is proclaimed as resolved, since it is considered that it does not have the same weight of testimonial evidence, by violating principles such as immediate and contradiction. Although its use is frequent and the different interview techniques have not undergone modifications, the technology, the audio and video recording systems have improved, allowing greater accessibility, fidelity and experiential approach to the viewers than what is recorded. In the oral criminal system with an accusatory tendency and the tools that employ the judicial operator a better evidentiary assessment, from the collection of the interview by the investigators, must guarantee the integrity of the activities carried out and the results, in the event of non-appearance from the witness to the public hearings; and it is precisely for this reason that the Procedural Law contemplates the reference test.
