It is of vital and transcendental importance in the study of current constitutional law, as well as legal theory, to deal with the analysis of the judicial precedent and its capacity to create binding sub-rules that are enforceable against the judges and users of the administration. of Justice. We will try not only to develop the nature of these sub-rules, but also to look at the position they occupy within the legal system. We will conclude, with perfect success, that determining the location that said precedents have in the Colombian legal staging will also be the power and binding nature that they have within the regulatory system.
