Deliberative Policy Within The Colombian Constitutional Court: Philosophical And Casuistic Analysis

The transition to the constitutional order proposed since the Political Constitution of 1991, accounts for a regime of democratic openness that provides mechanisms for citizens to dialogue with the institutions of power and generate spaces for debate and political control. This evidences the materialization of the elements of a deliberative democracy within the legal-political contexts that are presented, fundamentally, when the formal text contemplates a Constitutional Court that enables the participation of social circles, bringing democratic principles to the real field of collective deliberation. Hence, the study exposes: Firstly, the theoretical-philosophical framework that characterizes deliberative democracy and its application within the Colombian legal field, specifically, that related to the functional analysis of the Colombian Constitutional Court, evidenced from citizen interventions.
