Critical analysis of the functions of the Inter- American System of Human Rights in the Americas in general and Venezuela, in order to establish its scope, and the performance of its two working instruments: the Human Rights Commission and the American Court of Human Rights. It is shown that all human rights treaties and other documents reflect the notion that it is a primary duty of States to protect, respect and promote all human rights. In the case, the theoretical context was supported by authors like Faúndez (2004, 2011), Restrepo (2009), the Court of Human Rights (2012), Ortega (2011), Basch and others (2012), Salviolo (2011), among others. It could be concluded that the Inter-American Court and Commission have been playing an important role in the protection of fundamental rights in the region, like the Inter-American Human Rights is the area increased visibility and prestige has given the Organization of American Americans, giving responsibility to the State in relation to existing systems
