The anticipated old-age special pension: An analysis from the perspective of the theory of the symbolic efficacy of the right

This article is the result of a research project entitled "the constitutional and legal protection of the social insurance and pension system to a child in a situation of functional diversity in Colombia". The study is carried from the field of social insurance and pensions, and in particular relates to the economic benefit provided by the law in 2003, known as the old-age special early pension whose main goal is to provide protection to parents of children with functional diversity.
The research carried out an analysis of the economic benefit mentioned before in the light of the theory of symbolic efficacy of law, stating that the legislation ruling this right is part of a formal, rhetorical and symbolic level by not allowing a material reality to safeguard and protect this group, which is in a state of functional diversity, due to their vulnerability, they require special protection of the state, as required by clear constitutional precepts integrated into our legal system by requirements of the constitution.
