El fin transformativo de la justicia transicional: un análisis del contexto colombiano

La justicia transicional enfrenta críticas asociadas a su origen y desarrollo liberal, así como su excesiva verticalidad y legalismo. En este contexto, el giro transformativo surge como una forma de superar estas críticas a través de la ampliación de los objetivos de la transición. La justicia transicional transformativa propone que la transición es el momento adecuado para atender y resolver las causas estructurales del conflicto, sin embargo, al interior de esta corriente surgen diversos enfoques y, por ende, variedad de justificaciones y explicaciones acerca del significado y alcance de la transformación. En atención a este contexto, el articulo explora el significado de la justicia transicional transformativa en dos momentos. En primer lugar, reconstruye una aproximación teórica y propone una comprensión en dos sentidos: uno legal; que hace referencia a la defensa de los Derechos Económicos Sociales y Culturales y a la incorporación de la garantía de no repetición y, otro político, que se relaciona con la defensa de una paz positiva y la ampliación del concepto de justicia. En segundo lugar, conforme al esquema teórico planteado desarrolla una aproximación contextual al giro transformativo a través del análisis del caso colombiano. Aquí se defiende que en el caso colombiano se integraron mecanismos, estrategias y provisiones que se relacionan de manera directa con una visión transformativa de la justicia transicional, por lo cual se pone en evidencia que dicha corriente no solo es posible, sino que el caso colombiano es un ejemplo de la forma en la que puede ser incorporado a través de los acuerdos de paz.
