The transformative purpose of transitional justice: a contextual analysis of the Colombian case

Transitional justice faces criticism associated with its roots and liberal development, as well as its vertical and legalistic nature. Thus, the transformative turn has emerged to overcome these criticisms by broadening the goals of the transition. Transformative transitional justice proposes that the transition is the right time to address and resolve the structural causes of the conflict. However, within this tradition arise different approaches and, therefore, a variety of justifications and explanations about the meaning and scope of transformation. In attention to this context, the article explores the meaning of transformative transitional justice in two moments. In the first place, it reconstructs a theoretical approach and proposes an understanding in two ways: one legal; which refers to the integration of Economic, Social and Cultural Rights and the incorporation of the guarantee of non-repetition; and another political one, which is related to the defence of a positive peace and the expansion of the concept of justice. In a second place, according to analysed theoretical scheme, a contextual approach to the transformative turn is developed through the analysis of the Colombian case, here it is argued that in the Colombian case, mechanisms, strategies, and provisions that are directly related to a transformative vision were integrated in the peace agreement, which makes it clear that this tradition is not only possible, but that the Colombian case is an example of the way in which it can be incorporated through the peace agreements.
