Jurisdicción agraria y rural en Colombia: transformaciones y retos para la administración de justicia

Abstract

In Colombia, for decades there has been a need to implement regulations to achieve the objective of regulating an area of vital importance for a state, such as the agrarian and rural sector. Since the 20th century, the importance that should be given to this area has been evident, not only from an economic but also from a social perspective. Colombia has been characterized by a large number of historical facts of violence, in which the most affected have always been the peasants, since they had to be displaced from their lands on multiple occasions, due to this phenomenon. Through a reflective research, in a documentary analysis it was possible to reach a base idea that was developed throughout the work, where a logical sequence was carried out, of events, projects, reforms and benefits that brings with it the creation of an agrarian and rural jurisdiction in Colombia, which is why using all the information collected, it is left in evidence the need for its creation and implementation, which started as an idea proposed in the peace dialogues in 2016. This new jurisdiction brings many benefits to the country, especially for peasants and other ethnic communities that have been for many years, subject to injustice and neglect by the state, also includes the main initiative, which focuses on the peaceful resolution of conflicts over land and the restitution of these, to reward people who were displaced by violence. With the creation and implementation of this jurisdiction, greater protection is provided to these communities, and at the same time, better regulation is sought for issues relevant to the industrial, livestock and agricultural sectors. In this way, it is also possible to regulate relations between individuals in these areas, in terms of private property and land use for production purposes, with the aim of promoting a sustainable economy and improving the quality of life of farmers.
