El derecho y su impacto en el desarrollo. Líneas analíticas dominantes

En este artículo se trata de demostrar que la relación entre derecho y desarrollo económico se puede plantear de diversas maneras que no siempre son complementarias y en realidad denotan opciones diferentes de abordaje. Así en un primer momento el derecho se entendió como un instrumento idóneo para expresar y obtener las metas del desarrollo. Por su parte bajo los lineamentos de la economía neoinstitucional el sistema jurídico debe ofrecer un cuadro de incentivos adecuados para permitir un funcionamiento competitivo abierto y eficiente de los mercados. Finalmente en un extremo del debate se presentan las tesis que sostienen que el derecho no es ni un aliado ni un obstáculo para el desarrollo. Esta tesis sugestiva sin embargo es más un enunciado que precisa de mayores desarrollos para una adecuada sustentación.
