Algunas críticas al poder judicial constitucional
Keywords:
Constitutional court, legitimacy, paternalism, philosophy of law, constitutional lawAbstract
The objective of this article is to present some criticisms or objections to the constitutional judiciary, based on the various legal philosophical discussions that have arisen since the late 20th and early 21st centuries. These are quite complex and extensive. The research methodology is critical-analytic. We will present the criticisms currently underway, since while we are attempting to write this scientific literary sketch, many more criticisms are being developed by various authors. However, those that will be presented have been considered relevant. We will therefore find that the constitutional judiciary must be more democratic in order to have greater legitimacy.
