Abstract

Public procurement is a procedure carried out by public entities for the purpose of meeting the needs of both the administration and managed in compliance with the purposes of the constitutionally State. This procedure should be governed by a set of principles as advertising, transparency and objective selection, due to this it is intended that the contractual processes developed by public entities have plurality of bidders, ensuring that the most favorable offer is chosen for entity and compliance with the contractual object.

This article presents a descriptive research is done, for which are determined and analyzed various aspects and components of the current regulations, the operating entity hiring, consulting the official website of the municipality procurement and geographical conditions and location of the municipality, so is to determine what are the main reasons why the city of Encino Santander, in the period from 2012 to 2015 on the modalities bidding, abridged selection and merit-based competition isHe has introduced a small number of bidders.

The results obtained according to the revision of the public procurement website shows that of the 34 processes in public tendering procedures, selection and competition abbreviated merits that were conducted in the period from 2012 to 2015 in the town of Encino, only two bidders plurality of processes presented. This information was a review of the current contractual regulations finding that one of the possible and main causes of this situation is the autonomy that legally allows entities to determine requirements as experience and financial capacity, which affects plural participation of bidders in each process since there are doing this exercise responsibly, ie the requirements are exaggerated compared to the object, value and complexity of the contractual process ahead.
