Hiring of Betting, Lottery and Chance Sales Workers in The Metropolitan Area of Barranquilla during The Years 2020 to 2023

Abstract

This article researches labor and social security guarantees to the union of lottery, chance and permanent best sellers, now a days unprotected by the State, which is supposed to be the guarantor of their labor and social rights and who corresponds look after them. We begin with the historical evolution of the rent monopoly of the betting, lottery and chance sector at the head of the Colombian state, theoretically distinguishing each of these activities, showing the main characteristics of the workers of this union, carrying out a descriptive normative tour of the existing legislation. In the second chapter we identify what types of contracts regulate the employment relationship of these workers, the contractual typologies and legal protection mechanisms of betting, lottery and chance workers and the operating companies of this union. Coming to the third chapter where we establish the jurisprudential development that the Colombian High Courts have had on the hiring of betting, lottery and chance workers. The methodology used is qualitative, based on a current analysis of the employment situation of a worker in the sector within the metropolitan area of ​​Barranquilla, concluding that these workers do not have the minimum legal protection to guarantee them a decent job, that the evolution of regulations and labor guarantees is precarious, its progress has been mostly jurisprudential and there are not many judicial rulings on this matter.
