Analysis of reiforced job stability for workers without disability raiting evaluation

Law 361 of 1997 has the purpose of inclusion, integration and non-discrimination when hiring people due to their disability. But the above seems to protect only workers with loss of work capacity equal to, or greater than 15%, when speaking of severe, moderate and profound disability. Remaining silent in front of those not qualified. Therefore, it is important to establish whether it is admissible for the latter workers to be excluded from the benefits of such legal prerogatives, despite the fact they have health conditions that may affect their regular performance at work. To resolve this question, we have analyzed the jurisprudence stemming from the Constitutional Court and the Supreme Court of Justice regarding job stability. In order to identify if there is justification when differentiating within protection workers who may express their opinion and those who do not. Thus, how to determine under what circumstances the dismissal should be declared ineffective.
