In this work, a study will be drawn up, covering a broad range that is nothing more than the generality of the right to the filiation and the best interest of the minor, on the one hand. Throughout this research information will be collected on what is inherent to the best interest of the child and the application of the same in a process of filiation, just as it will be spoken of the fatherland of power, a small comparison will be made between legal and jurisprudential against the practice regarding the family court of the city of Valledupar, to know how frequent are the processes of this type, and in turn to see how responsible with the parents when facing a situation of recognition of paternity
