Over the years, the notion of family has evolved and, in turn, the concept of filiation has not remained unchanged, so its changes have varied both due to social dynamics and scientific advances.
In this order of ideas, it is important to allude to the source of filiation by consent in the use of human reproduction techniques, to which people resort so that, through these, they can achieve maternity or paternity by natural means.
Therefotre, since it is the free expression of consent that will generate the legal bond, the problem that can be generated by the absence of consent as an essential requirement prior to the use of assisted human reproduction techniques, both in the criminal and in the civil sphere, is obvious.
