The Evolution of The Right to Education in Colombia: From Statutory Right to Fundamental Constitutional Right

The right to Education in Colombia has evolved from its formal recognition as a basic right to that of a fundamental right, emphasizing its essential role in both individual and social development. Through various rulings by the Constitutional Court, it has been established that Education must not only be accessible but also of high quality and equitable for all, especially for children and adolescents. Furthermore, the regulatory framework and Education policies that have been analyzed and interpreted aim to guarantee the inclusion of vulnerable populations and address any challenges that may hinder or limit their Access. The importance of Education as a social service and a duty of the state us highlighted, which has emphasized that this right is a means for the full exercise of other fundamental rights, such as equality and human dignity
