Trans Women as Passive Subjects in the Crime of Feminicide: A Comparative Study Between Colombia and Other Legislations

This research explores the configuration of trans women as passive subjects in the crime of femicide through a normative review and a comparative approach between Colombia and other legislations. Despite attempts for the recognition and protection of the rights of minorities from a gender perspective, the justice systems still show important obstacles for the safeguarding of trans women. This is reflected annually in the figures of violence and murder against LGBTI groups, especially transvestites, transsexuals and transgender people. This study showed that Argentina and Colombia are the two Latin American countries with the greatest regulatory progress in the protection and recognition of trans women as women, which allows their aggressors to be tried for crimes such as femicide. However, countries such as Brazil, Mexico or Spain still have limitations in terms of regulatory development or gaps that do not leave clarity to the problem question posed in this research.
