Analysis of the Origin of Breach of Actions within the Context of a Suspended State Contract

The present investigative article includes a legal-descriptive analysis of the figure for the suspension of the state contract. It is carried out through the theoretical decomposition of the topic, having as its genesis the structure of the state contract; From there, the notion of suspension and its characteristic elements is developed. Likewise, the legal reference is made to the principle of "general interest and lucrative interest of the contractor", for the purpose of analyzing the weightability of the above assumptions, in accordance with the jurisprudence of the Council of State. This scheme allows us to recognize that the suspension, despite not having regulatory support, is conventionally applied by way of exception and temporarily; This indicates that its use is subject to the fact that, once the circumstances that led to its subscription are overcome, it is imperative to lift it and restart the contractual activities, without any reluctance of the contractual extremes, under penalty of constituting the actions of contractual breach.
